In a landmark ruling, the National Industrial Court in Port Harcourt, presided over by Hon. Justice Zaynab Bashir, has declared the termination of Mr. Patrick’s employment from United Bank for Africa (UBA) wrongful and in breach of his employment contract. The judgment, delivered on Wednesday, January 29, 2025, highlights critical issues surrounding employer-employee relationships, contract violations, and the enforcement of fair labor practices.
Mr. Patrick, who had served UBA as a Senior Banking Officer since August 7, 2008, had his employment terminated on January 22, 2014, under the vague premise of “services no longer required.” However, the court found that UBA failed to comply with its contractual obligations, particularly in regard to performance-based bonuses, salary entitlements, and proper termination procedures.
Key Judicial Rulings & Compensation Awarded
Justice Zaynab Bashir ordered UBA to pay Mr. Patrick:
- N8.25 million for two instances in which he was recognized as a role model in the bank’s appraisal reports.
- N2.25 million for another instance where he was deemed an outstanding performer.
- N2 million as general damages for wrongful termination.
The total award of N12.5 million is to be paid within 30 days.
Legal and Ethical Implications
The judgment raises fundamental questions about corporate accountability and fairness in employment practices. Mr. Patrick had argued that UBA failed to pay his performance bonuses before and after his termination, as well as half of his salaries for November and December 2013 and his full salary for January 2014.
In defense, UBA maintained that his services were no longer required and that all terminal benefits had been duly settled. However, the court ruled that UBA’s failure to pay Mr. Patrick’s salary in lieu of notice at the time of termination rendered the dismissal wrongful. The court also rejected Mr. Patrick’s claim for N75 million in damages, citing insufficient proof that UBA’s actions subjected him to inhumane treatment or psychological trauma.
A Case That Sets a Precedent
This ruling serves as a crucial reminder to corporations about the importance of adhering to contractual obligations and fair employment practices. It reinforces the necessity for employees to seek legal redress when they feel their rights have been violated. The case of Mr. Patrick against UBA will undoubtedly influence future disputes involving employment termination, disciplinary procedures, and financial entitlements.
As organizations strive for growth and profitability, this judgment underscores the need for ethical corporate governance and adherence to labor laws. For employees, it stands as a beacon of hope, affirming that justice can be served when due process is followed.
